Terms of Service

These Terms of Service ("Terms") govern your access to and use of PerchSight (the "Service"), a tool that lets you group social media accounts under brands, view their content and analytics, and publish to them from one dashboard. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to use the Service. You are responsible for the information you provide when you sign up, for keeping your credentials secure, and for all activity under your account. Tell us promptly if you believe your account has been compromised.
2. Connecting social accounts
The Service lets you connect accounts on third-party platforms, including Facebook, Instagram, TikTok and YouTube, through each platform's official authorization flow. By connecting an account, you confirm that you own it or are authorized to manage it, and you authorize PerchSight to access it on your behalf within the permissions you grant.
Your use of those platforms remains subject to their own terms and policies, including the Meta Terms of Service, the Instagram Terms of Use, the TikTok Terms of Service and the YouTube Terms of Service. PerchSight is not affiliated with, endorsed by or sponsored by any of these platforms. You can disconnect an account at any time from PerchSight or revoke access from the platform's own settings.
3. Your content
You keep all rights to the content you create, upload or publish through the Service. You grant PerchSight a limited licence to store, process, display and transmit that content only as needed to operate the Service for you, for example to publish a post to the accounts you choose or to show its statistics. You are solely responsible for your content and for making sure you have the rights needed to publish it.
4. Acceptable use
You agree not to:
- use the Service to publish content that is unlawful, infringing, deceptive, harassing or otherwise violates the policies of the connected platforms;
- send spam or use the Service for inauthentic or coordinated manipulation;
- connect accounts you are not authorized to manage;
- attempt to access other users' data, probe or break the Service's security, or interfere with its operation;
- scrape, reverse engineer or resell the Service, or use it to build a competing product.
5. Availability and changes
We are continually developing the Service and may add, change or remove features at any time. Features that depend on third-party platforms can stop working if those platforms change their APIs or revoke access. We do not guarantee that the Service will be uninterrupted or error-free.
6. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required to comply with the law or a platform's policies. On termination, we delete your data as described in our Privacy Policy.
7. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Analytics shown in the Service come from third-party platforms and may be delayed, incomplete or inaccurate.
8. Limitation of liability
To the fullest extent permitted by law, PerchSight will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim, or 100 USD if you paid nothing.
9. Indemnity
You agree to indemnify and hold PerchSight harmless from claims arising from your content, your use of the Service or your breach of these Terms.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, for material changes, notify you within the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.
